THE OFFICE OF THE COMPTROLLER OF THE CURRENCY (OCC), that was in response to our Letter to Senator Dodd Chairman of the Senate Banking Committee, dated September 3, 2007. Note that it even took them four and a half (4.5) months to return this pitiful answer. [OCC LOGO]

Dear Mr. Webster and Ms. Webster: The Office of the Comptroller of the Currency (OCC) is responding to you[r] letter regarding the above-mentioned bank. The focus of the OCC's review of consumer complaints against national banks is to determine whether the banks' actions are consistent with banking statutes, reguations or any policies that are applicable to nationally chartered banking institutions. In your correspondence with this agency, you complained about financing you received from the bank secured by a house in New York. The OCC contacted the bank, which responded directly to you by letter. A copy of the letter is enclosed for your review. The bank indicated that your dispute with it was the subject of pending litigation and referred future questions to its attorney. We have reviewed the correspondence. You dispute with the bank is the subject of litigation. Our office examines national banks to ensure their compliance with specific statutes within our delegated authority. However, where a clearly defined civil dispute develops, an agency such as the OCC would be acting beyond its authority in acting as a trier of fact or adjudicator of civil disputes. Further, we are not authorized to review the merits of the judicial decision ultimately reached. You may wish to consult an attorney, who can best advise you of any legal remedies available. The Customer Assistance Group's consumer complaint process is a service that is provided to customers ofr national banks. Information provided within this letter is specifically related to an individual consumer complaint and should not be construed as either a legal opinion of the OCC or a supervisory action.
We trust this is responsive to your concerns. If we can assist you
in the future, please do not hesitate to contact our office.
The OCC letter was not signed nor has any named officer or agent identified.
