The Great American Nightmare !
THEFT OF EQUITY FROM SENIORS or long term homeowners is just now rising to the surface. Many homeowners who thought they were refinancing their homes, just like us, have recently become aware, or are not yet aware, that they do not have, nor can they get a clear title to their property because THE ORIGINAL MORTGAGE, even though paid off, HAS NOT HAD THE SATISFACTION OF MORTGAGE filed with their County Clerk's Office, as required by law.
"How selling your home using brokers, lawyers, national lenders, and relying on some courts, can force you into foreclosure, bankruptcy, and create extreme stress, anger and rage."
Using red herrings, predatory lending practices, fraudulent documents, and a somewhat popular "consolidated mortgage" which is a complete worthless fraud, can prevent you from selling your home the old fashioned way, honestly.
This is a history of the problems you don't ever want to encounter or have to deal with. It should be mandatory reading in today's real estate market, especially if you think you currently have no problems.

COVER LETTER TO SENATOR DODD Chairman Committee on Banking, Housing and Urban Affairs. This is a 7 page cover Letter dated September 30, 2007, sent via delivery confirmation. We have never received any acknowledgement or confirmation from his office, or any indication that the serious and illegal matters would even be looked into. Not even a rejection. Recent events of the Senator's actions and lack of action, make it clear that he is completely unwilling to use his oversite committee to investigate any wrongdoing, even when documented.

His absurd response to his outed 2% sweetheart mortgage with Countrywide as being unusual, defies credulity, and is further prime facie proof that some of the national lenders are operating with impunity, as well as outside the law.

CHRONOLOGICAL ACCOUNT OF EVENTS: This is a 20 page, single spaced letter listing just some of the wrongs involving Wells Fargo's lending parctices, fraud committed on HUD and other Federal Documents.
FINANCIAL ANALYSIS OF REFINANCING A who's on first account used to create a complete, seperate, singed and binding "consolidated mortgage" filed in the County Clerk's office as an "agreement".
A frightening situation occurred last fall where the FBI got a conviction and 15 year sentence on a Richmond attorney who while performing refinancing kept the money that was to pay off the original mortgage, and failed to file the legally required satisfaction of mortgage. He did this for three years, in over 70 instances. If and when these mortgages are sold, the then current note and innocient mortgage holder can collect from the original mortgagor. The failure of the Congress and Oversite committees to protect the borrowers, and we are mostly talking about SENIORS, threatenes homeowners who will not be aware of their situation until they, or the estates, attempt to sell and cannot get a clear title.
